{"id":1195,"date":"2012-02-07T13:40:07","date_gmt":"2012-02-07T11:40:07","guid":{"rendered":"http:\/\/www.rhexpat.com\/blog\/?p=1195"},"modified":"2015-05-26T11:24:37","modified_gmt":"2015-05-26T09:24:37","slug":"information-des-salaries-expatries-sur-leur-protection-sociale","status":"publish","type":"post","link":"https:\/\/www.rhexpat.com\/blog\/information-des-salaries-expatries-sur-leur-protection-sociale\/","title":{"rendered":"Information des salari\u00e9s &#8220;expatri\u00e9s&#8221; sur leur protection sociale"},"content":{"rendered":"<p class=\"source\" style=\"text-align: justify;\">Voici un arr&ecirc;t int&eacute;ressant de la cour de Cassation en date du 25 janvier 2012 (Cass. soc. 25 janvier 2012, n&deg; 11-11374 FSPB)<\/p>\n<p style=\"text-align: justify;\">Cet arr&ecirc;t nous rappelle la n&eacute;cessit&eacute; pour l&#39;employeur de toujours communiquer et expliquer au salari&eacute; non seulement le type de contrat qui lui est appliqu&eacute; mais aussi la couverture sociale.<\/p>\n<p style=\"text-align: justify;\">Dans cet exemple l&#39;employeur est condamn&eacute; &agrave; verser des dommages et int&eacute;r&ecirc;ts au salari&eacute; pour d&eacute;faut d&#39;information du salari&eacute; sur sa situation au regard de sa couverture sociale, celui-ci ne sachant pas que l&#39;employeur ne cotisait pas au r&eacute;gime de base.<\/p>\n<p class=\"texte\" style=\"text-align: justify;\">&quot;Un salari&eacute; avait travaill&eacute; pendant plus de 20 ans &agrave; l&#39;&eacute;tranger, pour le compte de diverses filiales d&#39;un groupe du secteur de la restauration. Au moment de partir en retraite, l&#39;int&eacute;ress&eacute; s&#39;&eacute;tait aper&ccedil;u qu&#39;il n&#39;avait pas cotis&eacute; au r&eacute;gime d&#39;assurance vieillesse de la s&eacute;curit&eacute; sociale pendant son expatriation et qu&#39;il ne b&eacute;n&eacute;ficierait d&egrave;s lors que d&#39;une tr&egrave;s faible pension. Le salari&eacute; avait en cons&eacute;quence r&eacute;clam&eacute; &agrave; son employeur des dommages et int&eacute;r&ecirc;ts.<\/p>\n<p class=\"texte\" style=\"text-align: justify;\">\n\tLa Cour de cassation lui donne raison, au nom du principe selon lequel l&#39;employeur a l&#39;obligation d&#39;ex&eacute;cuter de bonne foi le contrat de travail. Ce principe implique en effet que l&#39;employeur doit informer le salari&eacute; expatri&eacute; de sa situation au regard de la protection sociale pendant la dur&eacute;e de son expatriation.<\/p>\n<p>\tPeu importe, comme le soutenait ici l&#39;employeur, que le bulletin de paie ne mentionne que des cotisations au titre de la retraite compl&eacute;mentaire. Cela ne permet pas n&eacute;cessairement au salari&eacute; d&#39;en d&eacute;duire qu&#39;il ne cotise pas au r&eacute;gime g&eacute;n&eacute;ral. L&#39;employeur aurait donc d&ucirc; le lui pr&eacute;ciser express&eacute;ment et l&#39;informer qu&#39;il avait la possibilit&eacute; d&#39;adh&eacute;rer volontairement au r&eacute;gime de
