style=\"text-align: justify;\">Voici un arr&ecirc;t int&eacute;ressant de la Cour de Cassation en date du 16 f&eacute;vrier 2012 concernant une clause de mobilit&eacute; pr&eacute;voyant une mutation &agrave; l&#39;&eacute;tranger.<\/div>\n<div style=\"text-align: justify;\">\n\tEn l&#39;esp&egrave;ce le salari&eacute; avait &eacute;t&eacute; embauch&eacute; en France par une premi&egrave;re soci&eacute;t&eacute;, puis mut&eacute; &agrave; une autre soci&eacute;t&eacute; du groupe toujours en France puis encore mut&eacute; &agrave; une autre soci&eacute;t&eacute;, toujours du Groupe et toujours en France. Ensuite le salari&eacute; a &eacute;t&eacute; licenci&eacute;, pour cause r&eacute;elle et s&eacute;rieuse, du fait de son refus de mutation en Chine.<\/p>\n<p>\tPour argumenter le licenciement la soci&eacute;t&eacute; se basait sur une clause de mobilit&eacute; sign&eacute;e entre les parties dans chaque contrat de travail qui pr&eacute;voyait une mobilit&eacute; au sein du groupe tant en France qu&#39;&agrave; l&#39;&eacute;tranger. Il &eacute;tait par ailleurs express&eacute;ment pr&eacute;vu dans la lettre d&#39;embauche initiale que le salari&eacute; serait mut&eacute; en Chine dans un d&eacute;lais de 2 &agrave; 3 ans sous r&eacute;serve que celui-ci donne satisfaction dans ses fonctions. Les conditions d&#39;embauche en Chine &eacute;taient m&ecirc;me pr&eacute;vues (contrat local et reprise d&#39;anciennet&eacute;).<\/p>\n<p>\tN&eacute;anmoins, la Cour d&#39;Appel et la Cour de Cassation ont toutes deux consid&eacute;r&eacute; que le salari&eacute; ne peut accepter par avance un changement d&#39;employeur, la clause de mobilit&eacute; &eacute;tait donc nulle et le licenciement &eacute;tait d&eacute;pourvu de cause r&eacute;elle et s&eacute;rieuse.<\/p>\n<p>\tDe plus dans ce cas d&#39;esp&egrave;ce la clause de mobilit&eacute; du contrat de travail ne comportait aucune pr&eacute;cision sur la zone g&eacute;ographique, se limitant d&#39;indiquer que la mutation pouvait avoir lieu aupr&egrave;s de toute soci&eacute;t&eacute; du Groupe en France ou &agrave; l&#39;&eacute;tranger.<\/p>\n<p>\tLien vers l&#39;arr&ecirc;t : <a href=\"http:\/\/www.legifrance.gouv.fr\/affichJuriJudi.do?oldAction=rechJuriJudi&amp;idTexte=JURITEXT000025383924&amp;fastReqId=1719403401&amp;fastPos=1\">Cass. soc. 16 f&eacute;vrier 2012, n&deg; 10-26542<\/a><\/p>\n<p>\tNous pouvons rappeler que la clause de mobilit&eacute; est la clause par laquelle le salari&eacute; s&#39;engage &agrave; accepter toutes mutations. N&eacute;anmoins, pour &ecirc;tre valable, elle doit obligatoirement (source juritravail.com):<\/p>\n<p>\t&#8211; d&eacute;finir clairement sa zone d&#39;application,<br \/>\n\t&#8211; &ecirc;tre mise en oeuvre de bonne foi,<br \/>\n\t&#8211; ne pas entra&icirc;ner la modification d&#39;un autre &eacute;l&eacute;ment du contrat de travail (ex : la r&eacute;mun&eacute;ration),<br \/>\n\t&#8211; ne pas porter une atteinte injustifi&eacute;e au droit &agrave; une vie familiale et personnelle.<\/div>\n<div style=\"text-align: justify;\">\n\tAinsi, il appara&icirc;t, dans un cas comme celui-ci, difficile d&#39;appliquer une clause de mobilit&eacute; pour une mutation en contrat local &agrave; l&#39;&eacute;tranger. En effet, si la zone g&eacute;ographique peut &ecirc;tre d&eacute;finie et la mise en oeuvre peut &ecirc;tre de bonne foi, il parait tr&egrave;s difficile qu&#39;il n&#39;y ait pas de modification d&#39;un autre &eacute;l&eacute;ment du contrat de travail dans le cas d&#39;une localisation (r&eacute;mun&eacute;ration, couverture sociale etc). On doit de plus tenir compte de cette jurisprudence qui rappelle qu&#39;un salari&eacute; ne peut accepter par avance un changement d&#39;employeur.<\/div>\n<a class=\"synved-social-button
