En l&#39;esp&egrave;ce un salari&eacute; expatri&eacute; qui a &eacute;t&eacute; licenci&eacute; par son employeur reprochait &agrave; son avocat d&#39;avoir manqu&eacute; &agrave; son obligation de conseil en n&#39;int&eacute;grant pas dans le montant de la r&eacute;mun&eacute;ration brute ayant servi de base au calcul de ses indemnit&eacute;s de rupture, les sommes correspondant &agrave; la fourniture d&#39;un logement et d&#39;un v&eacute;hicule de fonction ainsi qu&#39;&agrave; la prise en charge par l&#39;employeur des frais engag&eacute;s chaque ann&eacute;e pour rentrer en France avec sa famille durant ses cong&eacute;s pay&eacute;s.<\/p>\n<p>\tLa Cour d&#39;Appel et la Cour de Cassation donnent raison au salari&eacute; sur le logement et le v&eacute;hicule de fonction mais rejettent la demande concernant le voyage annuel.<\/p>\n<p>\tEn effet, la Cour de Cassation consid&egrave;re que la prise en charge du voyage annuel correspond &agrave; un remboursement de frais professionnels n&#39;ayant pas a &ecirc;tre int&eacute;gr&eacute;s dans le montant de la r&eacute;mun&eacute;ration. Le raisonnement est identique &agrave; celui appliqu&eacute; en mati&egrave;re de s&eacute;curit&eacute; sociale : Sont consid&eacute;r&eacute;es comme des frais professionnels les d&eacute;penses directement et uniquement li&eacute;es au d&eacute;tachement &agrave; l&#39;&eacute;tranger.<\/p>\n<p>\tPar contre la Cour donne raison au salari&eacute; concernant le logement et le v&eacute;hicule de fonction.<\/p>\n<p>\tAinsi en cas de licenciement d&#39;un salari&eacute; expatri&eacute; ou ayant &eacute;t&eacute; expatri&eacute; dans les douze derniers mois il faut faire tr&egrave;s attention &agrave; la d&eacute;termination de la r&eacute;mun&eacute;ration &agrave; prendre en compte. Nous pouvons rappeler que le salaire &agrave; prendre en consid&eacute;ration pour le calcul de l&#39;indemnit&eacute; de licenciement est, selon la formule la plus avantageuse pour le salari&eacute; :<\/p><\/div>\n<div style=\"text-align: justify;\">\n\t&#8211; soit 1\/12 de la r&eacute;mun&eacute;ration des 12 derniers mois pr&eacute;c&eacute;dant la notification du licenciement ;<br \/>\n\t&#8211; soit 1\/3 des 3 derniers mois. Dans ce cas, toute prime ou gratification de caract&egrave;re annuel ou exceptionnel, vers&eacute;e au salari&eacute; pendant cette p&eacute;riode, n&#39;est prise en compte que dans la limite d&#39;un montant calcul&eacute; &agrave; due proportion.<\/div>\n<div style=\"text-align: justify;\">\n\tIl s&rsquo;agit de la r&eacute;mun&eacute;ration brute per&ccedil;ue par le salari&eacute;. Il comprend la partie fixe et la partie variable de la r&eacute;mun&eacute;ration et inclut notamment les indemnit&eacute;s de cong&eacute;s pay&eacute;s vers&eacute;es par l&rsquo;employeur ou par une caisse de cong&eacute;s pay&eacute;s. Il comprend aussi toute prime ou gratification de caract&egrave;re annuel ou exceptionnel. Les gratifications &agrave; caract&egrave;re al&eacute;atoire ou temporaire sont donc incluses.<\/p>\n<p>\tPar r&eacute;mun&eacute;ration brute il ne faut donc pas juste penser salaire de base et primes annuelles mais bien se rappeler que les avantages en nature doivent &ecirc;tre consid&eacute;r&eacute;s comme faisant partie int&eacute;grante de cette r&eacute;mun&eacute;ration brute. <\/p>\n<p>\tToute la difficult&eacute; pour les expatri&eacute;s r&eacute;sidera donc dans la d&eacute;termination de ces avantages en nature. Parfois, et m&ecirc;me souvent pay&eacute;s localement, il appartiendra &agrave; la soci&eacute;t&eacute; d&#39;origine de r&eacute;cup&eacute;rer les informations n&eacute;cessaires &agrave; la valorisation de ces avantages. Il faudra &eacute;galement tenir compte du package d&#39;expatri&eacute; dans son ensemble et v&eacute;rifier les &eacute;l&eacute;ments &agrave; prendre en compte comme l&#39;&eacute;galisation fiscale, les primes d&#39;expatriation etc&#8230;<\/p><\/div>\n<a class=\"synved-social-button synved-social-button-share synved-social-size-24 synved-social-resolution-normal
