{"id":2017,"date":"2012-11-22T10:59:58","date_gmt":"2012-11-22T08:59:58","guid":{"rendered":"http:\/\/www.rhexpat.com\/blog\/?p=2017"},"modified":"2015-05-26T11:19:35","modified_gmt":"2015-05-26T09:19:35","slug":"refus-de-deplacement-ponctuel-et-faute-grave","status":"publish","type":"post","link":"https:\/\/www.rhexpat.com\/blog\/refus-de-deplacement-ponctuel-et-faute-grave\/","title":{"rendered":"Refus de d\u00e9placement ponctuel et faute grave"},"content":{"rendered":"<p style=\"text-align: justify;\">Dans un arr\u00eat du 24 octobre 2012 la Chambre Sociale de la Cour de Cassation s&#8217;est prononc\u00e9e sur un licenciement pour faute grave suite au refus d&#8217;un salari\u00e9 d&#8217;effectuer un d\u00e9placement \u00e0 l&#8217;\u00e9tranger.<\/p>\n<p style=\"text-align: justify;\">Dans le cas d&#8217;esp\u00e8ce le contrat de travail du salari\u00e9 comportait une clause de mobilit\u00e9. Le salari\u00e9 avait notamment pour mission contractuelle la maintenance en France et \u00e0 l&#8217;\u00e9tranger d&#8217;un robot auquel et il avait pris une part pr\u00e9pond\u00e9rante au d\u00e9veloppement. Ledit robot, vendu \u00e0 un client alg\u00e9rien, se trouvant en panne depuis plusieurs mois, en sorte que l<strong>a mission de quatre jours \u00e0 l&#8217;\u00e9tranger \u00e9tait justifi\u00e9e par l&#8217;int\u00e9r\u00eat de l&#8217;entreprise<\/strong> et que <strong>la sp\u00e9cificit\u00e9 des fonctions du salari\u00e9 impliquait de sa part une certaine mobilit\u00e9<\/strong>.<\/p>\n<p style=\"text-align: justify;\">La cour d&#8217;appel, \u00e9cartant par l\u00e0 m\u00eame l&#8217;argumentation tir\u00e9e d&#8217;une autre cause de licenciement, a pu d\u00e9cider que le refus r\u00e9it\u00e9r\u00e9 de l&#8217;int\u00e9ress\u00e9 d&#8217;effectuer ce d\u00e9placement constituait une faute grave rendant impossible son maintien dans l&#8217;entreprise et a, par ces seuls motifs, l\u00e9galement justifi\u00e9 sa d\u00e9cision.<\/p>\n<p style=\"text-align: justify;\">La cour de Cassation donne donc raison \u00e0 la Cour d&#8217;Appel et reconnait que le licenciement pour faute \u00e9tait justifi\u00e9 et ce malgr\u00e9 le fait que le d\u00e9placement privait le salari\u00e9 de deux jours de repos hebdomadaires.<\/p>\n<p style=\"text-align: justify;\">Il faut tout de m\u00eame rappeler qu&#8217;il s&#8217;agissait d&#8217;un d\u00e9placement de courte dur\u00e9e et que la fonction ainsi que la mission du salari\u00e9 pr\u00e9voyait clairement un
