{"id":2039,"date":"2012-12-18T17:19:00","date_gmt":"2012-12-18T15:19:00","guid":{"rendered":"http:\/\/www.rhexpat.com\/blog\/?p=2039"},"modified":"2015-05-26T11:19:09","modified_gmt":"2015-05-26T09:19:09","slug":"retour-dexpatriation-prise-dacte-de-la-rupture-du-contrat-de-travail","status":"publish","type":"post","link":"https:\/\/www.rhexpat.com\/blog\/retour-dexpatriation-prise-dacte-de-la-rupture-du-contrat-de-travail\/","title":{"rendered":"Retour d&#8217;expatriation &#8211; Prise d&#8217;acte de la rupture du contrat de travail"},"content":{"rendered":"<p style=\"text-align: justify;\">Voici une nouvelle jurisprudence concernant la fin d&#8217;expatriation et la question du reclassement en France, au sein de la soci\u00e9t\u00e9 m\u00e8re, pour un salari\u00e9 expatri\u00e9.<\/p>\n<p style=\"text-align: justify;\">Dans le cas d&#8217;esp\u00e8ce la Cour de Cassation confirme la position de la cour d&#8217;appel et rappelle le principe suivant :<\/p>\n<p style=\"text-align: justify;\">&#8220;&#8230;..que le salari\u00e9 expatri\u00e9 avait fait l&#8217;objet d&#8217;une mesure de rapatriement en France <strong>sans b\u00e9n\u00e9ficier d&#8217;une offre de r\u00e9int\u00e9gration s\u00e9rieuse, pr\u00e9cise et compatible avec l&#8217;importance de ses pr\u00e9c\u00e9dentes fonctions au sein de la soci\u00e9t\u00e9 m\u00e8re,<\/strong> d&#8217;autre part, <strong>qu&#8217;aucun accord expr\u00e8s de l&#8217;int\u00e9ress\u00e9 sur ce nouveau poste n&#8217;\u00e9tait intervenu<\/strong>, en a d\u00e9duit, sans \u00eatre tenue d&#8217;effectuer la recherche invoqu\u00e9e par la troisi\u00e8me branche, que <strong>la prise d&#8217;acte de la rupture \u00e9tait justifi\u00e9e<\/strong> ; que le moyen n&#8217;est pas fond\u00e9 ;&#8221;<\/p>\n<p style=\"text-align: justify;\">Donc on rappelle que l&#8217;offre de r\u00e9int\u00e9gration doit \u00eatre s\u00e9rieuse, pr\u00e9cise et compatible avec les fonctions pr\u00e9c\u00e9dentes au sein de la soci\u00e9t\u00e9 m\u00e8re. L&#8217;accord expr\u00e8s de l&#8217;int\u00e9ress\u00e9 doit par ailleurs \u00eatre obtenu.<\/p>\n<p style=\"text-align: justify;\">Dans le cas d&#8217;esp\u00e8ce la prise d&#8217;acte de la rupture du contrat de travail (produisant les effets d&#8217;un licenciement sans cause r\u00e9elle et s\u00e9rieuse) a \u00e9t\u00e9 confirm\u00e9e par la Cour au lendemain de la date officielle de l&#8217;expatriation du salari\u00e9 concern\u00e9 et ce malgr\u00e9 le fait que la soci\u00e9t\u00e9 avait propos\u00e9 un nouveau poste au salari\u00e9 en France, mais cette proposition est au final consid\u00e9r\u00e9e comme insuffisante par la Cour, par manque de pr\u00e9cisions et de formalisme dans le refus ou l&#8217;acceptation.<\/p>\n<p style=\"text-align: justify;\">Attention donc au retour d&#8217;expatriation et aux modalit\u00e9s pour proposer et valider l\u2019acceptation d&#8217;un nouveau poste en France au salari\u00e9 concern\u00e9.<\/p>\n<p style=\"text-align:
