Dans le cas d&#8217;esp\u00e8ce un salari\u00e9 Allemand a \u00e9t\u00e9 embauch\u00e9 et d\u00e9tach\u00e9 imm\u00e9diatement aupr\u00e8s d&#8217;une soci\u00e9t\u00e9 Fran\u00e7aise. Apr\u00e8s trois ann\u00e9es le salari\u00e9 a \u00e9t\u00e9 licenci\u00e9 par la soci\u00e9t\u00e9 Allemande. Le salari\u00e9 a alors saisi la juridiction prud&#8217;homale aux fins de voir dire la soci\u00e9t\u00e9 Fran\u00e7aise <strong>comme \u00e9tant son employeur et la voir condamner \u00e0 lui payer diverses sommes pour rupture abusive du contrat de travail.<\/strong><\/p>\n<p style=\"text-align: justify;\">Pour faire reconnaitre que la soci\u00e9t\u00e9 Fran\u00e7aise \u00e9tait en fait son employeur, le salari\u00e9 fait valoir que les conditions du d\u00e9tachement n&#8217;\u00e9taient pas respect\u00e9es :<\/p>\n<p style=\"text-align: justify;\">&#8211; Le d\u00e9tachement exclut que le salari\u00e9 soit recrut\u00e9 pour \u00eatre d\u00e9tach\u00e9<\/p>\n<p style=\"text-align: justify;\">&#8211; Le d\u00e9tachement doit \u00eatre temporaire<\/p>\n<p style=\"text-align: justify;\">Deux conditions qui n&#8217;\u00e9taient pas respect\u00e9es dans le cas du salari\u00e9 concern\u00e9.<\/p>\n<p style=\"text-align: justify;\">N\u00e9anmoins la Cour de Cassation affirme <strong>que le non-respect, par l&#8217;employeur \u00e9tranger, des r\u00e8gles relatives au d\u00e9tachement, sur le territoire national, d&#8217;un de ses salari\u00e9s, n&#8217;a pas pour effet de voir reconna\u00eetre la qualit\u00e9 d&#8217;employeur \u00e0 l&#8217;entreprise \u00e9tablie sur le territoire national et b\u00e9n\u00e9ficiaire dudit d\u00e9tachement.<\/strong><\/p>\n<p style=\"text-align: justify;\">La Cour de Cassation rejette donc le pourvoi aux faits qu&#8217;aucun lien de subordination entre la soci\u00e9t\u00e9 Fran\u00e7aise et le salari\u00e9 n&#8217;a \u00e9t\u00e9 d\u00e9montr\u00e9 par ce dernier.<\/p>\n<p><a
