{"id":2205,"date":"2013-03-05T14:54:58","date_gmt":"2013-03-05T12:54:58","guid":{"rendered":"http:\/\/www.rhexpat.com\/blog\/?p=2205"},"modified":"2013-10-16T18:24:27","modified_gmt":"2013-10-16T16:24:27","slug":"conges-payes-des-expatries","status":"publish","type":"post","link":"https:\/\/www.rhexpat.com\/blog\/conges-payes-des-expatries\/","title":{"rendered":"Cong\u00e9s pay\u00e9s des expatri\u00e9s"},"content":{"rendered":"<p style=\"text-align: justify;\">Voici un sujet qui revient tr\u00e8s souvent dans le cadre de la gestion des expatri\u00e9s: Les cong\u00e9s pay\u00e9s.<\/p>\n<p style=\"text-align: justify;\">Un des probl\u00e8mes dans la gestion des cong\u00e9s des expatri\u00e9s est le suivi de la prise de cong\u00e9s. De nombreuses entreprises qui maintiennent un bulletin de paie en France (expatri\u00e9 ou d\u00e9tach\u00e9 au sens de la s\u00e9curit\u00e9 sociale) continuent de faire courir les compteurs de cong\u00e9s pay\u00e9s. Dans de nombreux cas alors, la soci\u00e9t\u00e9 Fran\u00e7aise n&#8217;ayant pas forcement l&#8217;information de la prise de cong\u00e9s du salari\u00e9 expatri\u00e9, ne modifie pas le compteur et le salari\u00e9 se retrouve avec un compteur de cong\u00e9s pay\u00e9s en paie France qui est erron\u00e9.<\/p>\n<p style=\"text-align: justify;\">Comme on peut parfaitement l&#8217;imaginer un compteur erron\u00e9 ayant cumul\u00e9 parfois quelques ann\u00e9es d&#8217;expatriation posera probl\u00e8me en cas de d\u00e9mission ou licenciement du salari\u00e9&#8230;.faudra-t-il alors solder ces cong\u00e9s cumul\u00e9s sur les compteurs de la paie France ?<\/p>\n<p style=\"text-align: justify;\">Bien \u00e9videment afin d&#8217;\u00e9viter tout probl\u00e8me il est pr\u00e9f\u00e9rable de tenir les compteurs \u00e0 jour&#8230;mais si ce n&#8217;est pas fait quelle est la position de la Cour de Cassation ?<\/p>\n<p style=\"text-align: justify;\">Dans un arr\u00eat dat\u00e9 du 9 janvier 2013 la Cour de Cassation a \u00e9t\u00e9 interrog\u00e9e sur cette question. Dans le cas d&#8217;esp\u00e8ce un salari\u00e9 dont le contrat de travail prenait fin suite \u00e0 un probl\u00e8me de reclassement apr\u00e8s une expatriation, r\u00e9clamait le paiement des cong\u00e9s pay\u00e9s non pris durant certaines ann\u00e9es de son expatriation.<\/p>\n<p style=\"text-align: justify;\">Pour faire valoir sa demande le salari\u00e9 a produit devant la Cour deux \u00e9l\u00e9ments : l&#8217;attestation d&#8217;un autre salari\u00e9 de l&#8217;entreprise qui confirmait le caract\u00e8re courant de la pratique de cumul des cong\u00e9s pay\u00e9s sur plusieurs ann\u00e9es pour les expatri\u00e9s et les fiches individuelles de cong\u00e9s, \u00e9tablies par l&#8217;employeur lui-m\u00eame, sur lesquelles figuraient le cumul de ses jours de cong\u00e9s pay\u00e9s sur plusieurs ann\u00e9es et mentionnaient le solde des jours restant dus.<\/p>\n<p style=\"text-align: justify;\">A ceci la Cour d&#8217;Appel r\u00e9pond au salari\u00e9 que <strong>n&#8217;attestant pas d&#8217;une autorisation expresse de son employeur<\/strong> pour reporter les cong\u00e9s pay\u00e9s non pris au 31 mai de l&#8217;ann\u00e9e suivante elle ne pouvait consid\u00e9rer que les cong\u00e9s avaient \u00e9t\u00e9 report\u00e9s et donc devaient \u00eatre sold\u00e9s par le biais d&#8217;une indemnit\u00e9 compensatrice. Les cong\u00e9s non pris \u00e9taient donc perdus.<\/p>\n<p style=\"text-align: justify;\">Le salari\u00e9 quant \u00e0 lui argumente devant la Cour de Cassation que l&#8217;accord de l&#8217;employeur peut se d\u00e9duire de la mention du solde des cong\u00e9s pay\u00e9s sur les bulletins de paie ou sur tout autre document \u00e9manant de l&#8217;employeur.<\/p>\n<p style=\"text-align: justify;\">La Cour de Cassation rejette le pourvoi du salari\u00e9 et confirme que sans <strong>autorisation expresse<\/strong> de l&#8217;employeur on ne peut consid\u00e9rer que les cong\u00e9s \u00e9taient report\u00e9s.<\/p>\n<p style=\"text-align: justify;\">La difficult\u00e9 d&#8217;avoir des compteurs \u00e0 jour pour les employeurs est donc att\u00e9nu\u00e9e par cet arr\u00eat de la Cour de Cassation. Bien entendu si l&#8217;ann\u00e9e en cours le compteur n&#8217;est pas \u00e0 jour le cong\u00e9s devront \u00eatre sold\u00e9s&#8230;<\/p>\n<p style=\"text-align: justify;\">Attention tout de m\u00eame aux dispositions particuli\u00e8res des conventions collectives et \u00e9galement aux cas pr\u00e9cis autoris\u00e9s par la loi de report de cong\u00e9s pay\u00e9s.<\/p>\n<p
