{"id":2233,"date":"2013-06-27T09:45:02","date_gmt":"2013-06-27T07:45:02","guid":{"rendered":"http:\/\/www.rhexpat.com\/blog\/?p=2233"},"modified":"2015-05-26T11:17:19","modified_gmt":"2015-05-26T09:17:19","slug":"reclassement-des-salaries-expatries-confirmation-de-la-jurisprudence-actuelle","status":"publish","type":"post","link":"https:\/\/www.rhexpat.com\/blog\/reclassement-des-salaries-expatries-confirmation-de-la-jurisprudence-actuelle\/","title":{"rendered":"Reclassement des salari\u00e9s expatri\u00e9s : Confirmation de la jurisprudence actuelle"},"content":{"rendered":"<p style=\"text-align: justify;\">Dans un arr\u00eat du 09 janvier 2013, la Cour de cassation a une nouvelle fois confirm\u00e9 son interpr\u00e9tation de l&#8217;article L 1231-5 du Code du travail, relatif \u00e0 l&#8217;obligation de rapatriement et de reclassement des salari\u00e9s expatri\u00e9s.<\/p>\n<p style=\"text-align: justify;\">Dans son alin\u00e9a 1, cet article pr\u00e9voit que &#8220;lorsqu&#8217;un salari\u00e9 engag\u00e9 par une soci\u00e9t\u00e9 m\u00e8re a \u00e9t\u00e9 mis \u00e0 la disposition d&#8217;une filiale \u00e9trang\u00e8re et qu&#8217;un contrat de travail a \u00e9t\u00e9 conclu avec cette derni\u00e8re, la soci\u00e9t\u00e9 m\u00e8re assure son rapatriement en cas de licenciement par la filiale et lui procure un nouvel emploi compatible avec l&#8217;importance de ses pr\u00e9c\u00e9dentes fonctions en son sein.&#8221;<\/p>\n<p style=\"text-align: justify;\">Dans un arr\u00eat du 7 d\u00e9cembre 2011, la Cour de cassation avait op\u00e9r\u00e9 un revirement de jurisprudence important, en d\u00e9cidant que le seul fait pour le salari\u00e9 de ne pas avoir exerc\u00e9 des fonctions effectives au service de l&#8217;employeur l&#8217;ayant d\u00e9tach\u00e9, avant son d\u00e9tachement, ne dispense pas celui-ci de son obligation d&#8217;assurer son rapatriement \u00e0 la fin du d\u00e9tachement et de le reclasser dans un autre emploi en rapport avec ses comp\u00e9tences.<br \/>\nLa Haute juridiction s&#8217;\u00e9tait \u00e9cart\u00e9e ici d&#8217;une interpr\u00e9tation stricte de l&#8217;article L 1231-5, pr\u00e9f\u00e9rant appliquer l&#8217;esprit du texte. Ainsi, il apparait que l&#8217;obligation de rapatriement et de reclassement p\u00e8se sur la soci\u00e9t\u00e9 m\u00e8re, d\u00e8s lors qu&#8217;elle est \u00e0 l&#8217;origine de l&#8217;expatriation.<\/p>\n<p style=\"text-align: justify;\">Dans ce nouveau cas d&#8217;esp\u00e8ce, un salari\u00e9 avait sign\u00e9 un\u00a0 contrat de travail avec une soci\u00e9t\u00e9 fran\u00e7aise, \u00e9galement soci\u00e9t\u00e9 m\u00e8re du groupe, pour \u00eatre d\u00e9tach\u00e9 imm\u00e9diatement dans une filiale au S\u00e9n\u00e9gal. Le contrat de travail et son avenant \u00e9taient tous deux dat\u00e9s du m\u00eame jour. Le contrat local ayant \u00e9t\u00e9 rompu, le salari\u00e9 s&#8217;est vu licencier 2 mois plus tard par la soci\u00e9t\u00e9 m\u00e8re. Il a donc saisit la juridiction prud&#8217;homale estimant que la soci\u00e9t\u00e9 m\u00e8re n&#8217;avait satisfait ni \u00e0 son obligation de rapatriement ni \u00e0 son obligation de reclassement. La Cour d&#8217;Appel donnant raison au salari\u00e9, l&#8217;employeur s&#8217;\u00e9tait pourvu en cassation o\u00f9 il a vu sa demande rejet\u00e9e, aux motifs que &#8220;le seul fait que le salari\u00e9 n&#8217;ait pas, avant son d\u00e9tachement, exerc\u00e9 des fonctions effectives au service de l&#8217;employeur qui l&#8217;a d\u00e9tach\u00e9 ne dispense pas celui-ci de son obligation d&#8217;assurer son rapatriement \u00e0 la fin du d\u00e9tachement et de le reclasser dans un autre emploi en rapport avec ses comp\u00e9tences&#8221;.<\/p>\n<p style=\"text-align: justify;\">Par ailleurs, il est int\u00e9ressant de relever que la Cour de cassation consid\u00e8re ici le licenciement comme \u00e9tant sans cause r\u00e9elle et s\u00e9rieuse puisque le &#8220;salari\u00e9 n&#8217;avait jamais \u00e9t\u00e9 mis en mesure de conna\u00eetre le poste qu&#8217;il \u00e9tait cens\u00e9 occuper, la soci\u00e9t\u00e9 m\u00e8re s&#8217;\u00e9tant content\u00e9e de lui indiquer qu&#8217;il serait affect\u00e9 \u00e0 la direction financi\u00e8re&#8221;.<br \/>\nEn cons\u00e9quence, l&#8217;obligation de reclassement impose \u00e0 la soci\u00e9t\u00e9 m\u00e8re de procurer un minimum d&#8217;informations sur le ou les postes propos\u00e9s au salari\u00e9 lors de sa r\u00e9int\u00e9gration.<\/p>\n<p style=\"text-align:
