{"id":2248,"date":"2013-09-25T13:43:32","date_gmt":"2013-09-25T11:43:32","guid":{"rendered":"http:\/\/www.rhexpat.com\/blog\/?p=2248"},"modified":"2015-05-26T11:16:50","modified_gmt":"2015-05-26T09:16:50","slug":"lintroduction-du-nouveau-statut-de-salarie-actionnaire-au-royaume-uni","status":"publish","type":"post","link":"https:\/\/www.rhexpat.com\/blog\/lintroduction-du-nouveau-statut-de-salarie-actionnaire-au-royaume-uni\/","title":{"rendered":"L&#8217;introduction du nouveau statut de salari\u00e9 actionnaire au Royaume-Uni"},"content":{"rendered":"<p>Depuis le 1er Septembre 2013, \u00e0 l&#8217;initiative du chancelier George Osborne, les employeurs ont la possibilit\u00e9 de proposer des contrats de travail dont le b\u00e9n\u00e9ficiaire aura le statut de salari\u00e9 actionnaire.<\/p>\n<p>Ce nouveau statut implique que le salari\u00e9 doive renoncer \u00e0 certains de ses droits, en \u00a0contrepartie du paiement en actions de l&#8217;entreprise, d&#8217;un montant \u00a0minimum de 2000\u00a3. Ces 2000 \u00a3 ne sont soumis \u00e0 aucun pr\u00e9l\u00e8vement social ni imp\u00f4t sur le revenu.<\/p>\n<p>La l\u00e9gislation pr\u00e9voit que les droits dont les salari\u00e9s ne pourront plus se pr\u00e9valoir sont les suivants:<\/p>\n<p>&#8211; Le droit d&#8217;intenter une action en justice pour licenciement injustifi\u00e9 (sauf lorsque le licenciement est &#8220;fond\u00e9&#8221; sur des motifs discriminatoires ou en relation avec la sant\u00e9 et la s\u00e9curit\u00e9)<\/p>\n<p>&#8211; Le droit aux indemnit\u00e9s l\u00e9gales de licenciement<\/p>\n<p>&#8211; Le droit de demander des horaires de travail flexibles (sauf pour les 2 semaines suivant le retour d&#8217;un cong\u00e9 parental)<\/p>\n<p>&#8211; Le droit de demander du temps libre pour \u00e9tudier ou se former<\/p>\n<p>&#8211; La notification du souhait d&#8217;avancer le terme du cong\u00e9 maternit\u00e9 \/ paternit\u00e9 ou\u00a0 apr\u00e8s une adoption est doubl\u00e9. Il passe de 8 \u00e0 16 semaines.<\/p>\n<p>Ce statut peut \u00eatre propos\u00e9 aux nouveaux salari\u00e9s mais \u00e9galement aux salari\u00e9s d\u00e9j\u00e0 en place. Cependant, il n&#8217;est pas possible pour l&#8217;employeur de contraindre une personne de l&#8217;accepter.<\/p>\n<p>Afin d&#8217;\u00e9clairer le salari\u00e9 sur les implications li\u00e9es \u00e0 ce nouveau statut, la l\u00e9gislateur a pr\u00e9vu une proc\u00e9dure stricte :<\/p>\n<p>1 &#8211; Lorsqu&#8217;un employer souhaite offrir \u00e0 un individu ou \u00e0 un de ses salari\u00e9s le statut de salari\u00e9 actionnaire, il doit fournir un document \u00e9crit qui mentionne les particularit\u00e9s de ce statut.<\/p>\n<p>2 &#8211; A r\u00e9ception du document, il est pr\u00e9vu que le b\u00e9n\u00e9ficiaire de l&#8217;offre se fasse assister par un conseiller ind\u00e9pendant (avocat, syndicat&#8230;), afin de se faire expliquer les conditions et les effets juridiques en cas d&#8217;acceptation. Il appartient \u00e0 l&#8217;individu lui-m\u00eame de contacter ce conseiller.<\/p>\n<p>3 &#8211; A compter du jour suivant la rencontre avec le conseiller, le titulaire de l&#8217;offre doit prendre 7 jours calendaires de r\u00e9flexion, avant de donner sa r\u00e9ponse.
