{"id":2451,"date":"2014-02-18T11:49:35","date_gmt":"2014-02-18T09:49:35","guid":{"rendered":"http:\/\/www.rhexpat.com\/blog\/?p=2451"},"modified":"2015-05-26T11:13:23","modified_gmt":"2015-05-26T09:13:23","slug":"changement-de-statut-de-letudiant-etranger-titulaire-dun-master-a-salarie","status":"publish","type":"post","link":"https:\/\/www.rhexpat.com\/blog\/changement-de-statut-de-letudiant-etranger-titulaire-dun-master-a-salarie\/","title":{"rendered":"Changement de statut de l\u2019\u00e9tudiant \u00e9tranger titulaire d\u2019un master \u00e0 salari\u00e9"},"content":{"rendered":"<p style=\"text-align: justify;\">De nombreuses entreprises souhaitent recruter des \u00e9tudiants \u00e9trangers \u00e0 l\u2019issue de leurs \u00e9tudes effectu\u00e9es en France mais beaucoup n\u2019osent pas s\u2019engager dans les d\u00e9marches administratives que cela engendre.<\/p>\n<p style=\"text-align: justify;\">Des mesures ont \u00e9t\u00e9 prises pour simplifier ces embauches et notamment depuis l\u2019abrogation de la circulaire dite \u00ab Gu\u00e9ant \u00bb et l\u2019entr\u00e9e en vigueur de la loi du 22 juillet 2013 relative \u00e0 l\u2019enseignement sup\u00e9rieur et \u00e0 la recherche, et mise en application par la circulaire du 30 juillet 2013.<\/p>\n<p style=\"text-align: justify;\">En effet, l\u2019accueil d\u2019\u00e9trangers dipl\u00f4m\u00e9s pour une premi\u00e8re exp\u00e9rience professionnelle en France profite \u00e0 des secteurs d\u2019activit\u00e9 importants et contribue au d\u00e9veloppement des relations \u00e9conomiques avec certains pays \u00e9mergents. En France, 12% des \u00e9tudiants sont \u00e9trangers contre 10 % en Allemagne et 22 % au Royaume-Uni.<\/p>\n<p style=\"text-align: justify;\">Ainsi, \u00e0 l\u2019issue de leurs \u00e9tudes, les \u00e9trangers titulaires d\u2019un dipl\u00f4me au moins \u00e9quivalent au grade de Master ont <b>deux possibilit\u00e9s<\/b>\u00a0:<\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"text-decoration: underline;\">Faire une demande d\u2019autorisation provisoire de s\u00e9jour (APS): <\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\">&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 au plus tard <b>quatre mois avant l&#8217;expiration du titre<\/b> de s\u00e9jour \u00ab\u00a0\u00e9tudiant\u00a0\u00bb\u00a0; la pr\u00e9sentation du dipl\u00f4me pouvant \u00eatre diff\u00e9r\u00e9e au moment de la remise de l\u2019APS<\/p>\n<p style=\"text-align: justify;\">&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 valable 12 mois et non renouvelable,<\/p>\n<p style=\"text-align: justify;\">&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 dans le but de\u00a0:<\/p>\n<blockquote>\n<ol>\n<li style=\"font-size: 12px;\"><b>chercher un emploi<\/b> (tout en pouvant continuer \u00e0 travailler \u00e0 titre accessoire dans la limite de 60% d\u2019un temps plein annuellement)<\/li>\n<li style=\"font-size: 12px;\"><b>exercer un emploi \u00e0 temps plein<\/b> en relation avec la formation effectu\u00e9e et r\u00e9mun\u00e9r\u00e9 au moins 1,5 fois le SMIC. L\u2019\u00e9tudiant devra alors faire une demande de carte de s\u00e9jour \u00ab\u00a0salari\u00e9\u00a0\u00bb dans les 15 jours suivant la conclusion de son contrat, pour changer de statut et sans que la situation de l\u2019emploi ne soit opposable<\/li>\n<li style=\"font-size: 12px;\"><b>exercer un emploi \u00e0 temps partiel<\/b> (60%) si la r\u00e9mun\u00e9ration propos\u00e9e est inf\u00e9rieure \u00e0 1,5 fois le SMIC, avant de d\u00e9poser une demande de changement de statut et d\u2019obtenir son titre de s\u00e9jour\u00a0\u00ab\u00a0salari\u00e9\u00bb lui permettant de travailler \u00e0 plein temps. La situation de l\u2019emploi sera alors opposable.<\/li>\n<\/ol>\n<\/blockquote>\n<p style=\"text-align: justify;\"><b>L\u2019APS est peu d\u00e9livr\u00e9e par l\u2019administration car les \u00e9tudiants ne pensent pas \u00e0 la demander quatre mois avant l\u2019expiration de leur titre de s\u00e9jour et ignorent qu\u2019elle n\u2019est pas li\u00e9e \u00e0 l\u2019obtention du dipl\u00f4me.<\/b><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"text-decoration: underline;\">Faire directement une demande de changement de statut de droit commun<\/span>:<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <b>S\u2019il a d\u00e9j\u00e0 trouv\u00e9 un emploi \u00e0 l\u2019issue de ses \u00e9tudes et s\u2019il a d\u00e9pass\u00e9 le d\u00e9lai des 4 mois<\/b> pour demander une APS, l\u2019\u00e9tudiant \u00e9tranger peut faire une demande de changement de statut de droit commun, dans les deux mois pr\u00e9c\u00e9dant l\u2019expiration de son titre de s\u00e9jour et jusqu\u2019au dernier jour pr\u00e9c\u00e9dant l\u2019expiration de son titre \u00ab\u00a0\u00e9tudiant\u00a0\u00bb.<\/p>\n<p style=\"text-align: justify;\">&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 La situation de l\u2019emploi est opposable (publication de l\u2019offre d\u2019emploi pendant au moins trois semaines)<\/p>\n<p style=\"text-align: justify;\">&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Dans l\u2019attente de l\u2019accord de l\u2019administration, l\u2019\u00e9tranger est maintenu sous les conditions du statut \u00e9tudiant donc il ne pourra travailler que dans la limite de 60% de la dur\u00e9e l\u00e9gale du travail.<\/p>\n<p style=\"text-align: justify;\"><span style=\"color:
