{"id":2457,"date":"2014-02-25T11:25:06","date_gmt":"2014-02-25T09:25:06","guid":{"rendered":"http:\/\/www.rhexpat.com\/blog\/?p=2457"},"modified":"2015-05-26T11:13:08","modified_gmt":"2015-05-26T09:13:08","slug":"limportance-dune-bonne-redaction-de-lavenant-du-contrat-de-travail","status":"publish","type":"post","link":"https:\/\/www.rhexpat.com\/blog\/limportance-dune-bonne-redaction-de-lavenant-du-contrat-de-travail\/","title":{"rendered":"L\u2019importance de la r\u00e9daction de l\u2019avenant au contrat de travail"},"content":{"rendered":"<p style=\"text-align: justify;\"><a href=\"http:\/\/legimobile.fr\/fr\/jp\/j\/c\/civ\/soc\/2013\/11\/27\/12-23603\/\" target=\"_blank\"><b><span style=\"text-decoration: underline;\">Cass. soc., 27 Novembre 2013, n\u00b0 12-23.603, CASSATION<\/span><\/b><\/a><\/p>\n<p style=\"text-align: justify;\"><b>L\u2019employeur doit-il affilier le salari\u00e9 envoy\u00e9 en mission \u00e0 l\u2019\u00e9tranger au r\u00e9gime fran\u00e7ais de s\u00e9curit\u00e9 sociale lorsqu\u2019il s\u2019engage \u00e0 d\u00e9tacher le salari\u00e9 mais que les conditions de l\u2019article L. 761-1 du code de la s\u00e9curit\u00e9 sociale relatif au d\u00e9tachement interne ne sont pas remplies\u00a0?<\/b><\/p>\n<p style=\"text-align: justify;\">Dans cet arr\u00eat du 27 novembre 2013 la Cour de Cassation casse un arr\u00eat de la Cour d&#8217;Appel, condamne l&#8217;employeur aux d\u00e9pens et renvoi les parties devant la Cour d&#8217;appel. En l&#8217;esp\u00e8ce, un salari\u00e9 r\u00e9clamait des dommages-int\u00e9r\u00eats en r\u00e9paration du pr\u00e9judice r\u00e9sultant du fait que son employeur ne l&#8217;avait pas affili\u00e9 au r\u00e9gime g\u00e9n\u00e9ral de la s\u00e9curit\u00e9 sociale alors que ses avenants stipulaient qu&#8217;il serait &#8220;soumis au r\u00e8glement sp\u00e9cial sur le d\u00e9tachement du personnel&#8221;.<\/p>\n<p style=\"text-align: justify;\">L&#8217;employeur, \u00e0 qui la Cour d&#8217;appel donne raison, pr\u00e9cise &#8220;qu&#8217;en application des dispositions de l&#8217;article L. 761-1 du code de la s\u00e9curit\u00e9 sociale, seuls les travailleurs d\u00e9tach\u00e9s temporairement \u00e0 l&#8217;\u00e9tranger par leur employeur demeurent soumis \u00e0 la l\u00e9gislation fran\u00e7aise de s\u00e9curit\u00e9 sociale, et que M. X&#8230; n&#8217;a pas la qualit\u00e9 de salari\u00e9 d\u00e9tach\u00e9 au sens de ce texte, nonobstant les formulations \u00ab d\u00e9tach\u00e9 \u00bb et \u00ab d\u00e9tachement \u00bb maladroitement employ\u00e9es&#8221;. Le salari\u00e9 \u00e9tait en fait expatri\u00e9 au sens de la s\u00e9curit\u00e9 sociale et en avait \u00e9t\u00e9 inform\u00e9 de mani\u00e8re compl\u00e8te et loyale.<\/p>\n<p style=\"text-align: justify;\">En r\u00e9sum\u00e9, les avenants du salari\u00e9 indiquaient qu&#8217;il serait d\u00e9tach\u00e9 et soumis au r\u00e8glement sp\u00e9cial du d\u00e9tachement. En r\u00e9alit\u00e9 le salari\u00e9 ne pouvait \u00eatre d\u00e9tach\u00e9 s\u00e9curit\u00e9 sociale et maintenu au r\u00e9gime obligatoire fran\u00e7ais, il \u00e9tait expatri\u00e9.<\/p>\n<p style=\"text-align: justify;\">La Cour de Cassation consid\u00e8re que les mentions figurant dans l\u2019avenant de d\u00e9tachement au contrat de travail du salari\u00e9 lient l\u2019employeur (article\u00a01134 et 1147 du code civil).<\/p>\n<p style=\"text-align: justify;\">Lorsque l\u2019employeur s\u2019engage \u00e0 d\u00e9tacher le salari\u00e9\u00a0dans l\u2019avenant de d\u00e9tachement au contrat de travail\u00a0(\u00ab\u00a0<i>conservation des droits \u00e0 pension comme s\u2019il avait poursuivi son activit\u00e9 en France\u00a0<\/i>\u00bb), il doit cotiser pour son salari\u00e9 au r\u00e9gime fran\u00e7ais de s\u00e9curit\u00e9 sociale.\u00a0 A d\u00e9faut, il devra payer des dommages et int\u00e9r\u00eats.<\/p>\n<p style=\"text-align: justify;\">Il importe peu que les conditions relatives au d\u00e9tachement interne pr\u00e9vues \u00e0 l\u2019article L. 761-1 du code de la s\u00e9curit\u00e9 sociale ne soient pas remplies (caract\u00e8re temporaire de la mission effectu\u00e9e \u00e0 l&#8217;\u00e9tranger, exercice d&#8217;une activit\u00e9 salari\u00e9e pour le compte de l&#8217;employeur fran\u00e7ais d&#8217;origine, maintien de la r\u00e9mun\u00e9ration par celui-ci qui s&#8217;acquitte des cotisations sociales aff\u00e9rentes \u00e0 cette m\u00eame r\u00e9mun\u00e9ration) et que le formalisme r\u00e9glementaire ne soit pas respect\u00e9.<\/p>\n<p style=\"text-align: justify;\"><strong>Conclusion: <\/strong>Il faut porter une grande attention \u00e0 la r\u00e9daction des avenants. Lorsque le salari\u00e9 est expatri\u00e9 au sens de la s\u00e9curit\u00e9 sociale il convient de ne pas titrer &#8220;Avenant de d\u00e9tachement&#8221; ou d&#8217;utiliser le terme d\u00e9tach\u00e9, m\u00eame si celui-ci fait r\u00e9f\u00e9rence au droit du travail. Une clause pr\u00e9cise et claire doit \u00eatre accord\u00e9e \u00e0 la protection sociale du salari\u00e9 en mobilit\u00e9 internationale ou l&#8217;employeur pr\u00e9cisera en d\u00e9tail quel est le statut du salari\u00e9 (d\u00e9tache ou expatri\u00e9) et quelle sera sa couverture sociale.<\/p>\n<a class=\"synved-social-button synved-social-button-share synved-social-size-24
