R\u00e9sidant en France, il demande \u00e0 P\u00f4le Emploi le b\u00e9n\u00e9fice des prestations d\u2019assurance ch\u00f4mage<b>.<\/b> P\u00f4le Emploi lui refuse le b\u00e9n\u00e9fice de l\u2019allocation ch\u00f4mage.<\/p>\n<p style=\"text-align: justify;\">Les juges du fond rejettent la demande form\u00e9e par le salari\u00e9. Ils appliquent la r\u00e9glementation fran\u00e7aise (article L. 5421-1 du Code du travail et article 2 de la Convention d\u2019assurance ch\u00f4mage du 1<sup>er<\/sup> janvier 2011)\u00a0qui exige en cas de d\u00e9mission volontaire pour non paiement du salaire de produire une ordonnance de r\u00e9f\u00e9r\u00e9 (*).<\/p>\n<p style=\"text-align: justify;\">Le salari\u00e9 forme un pourvoi en cassation, il invoque le droit allemand selon lequel \u00ab\u00a0<i>est autoris\u00e9e la rupture quand l\u2019employeur ne paie pas les salaires dus ou les paie irr\u00e9guli\u00e8rement\u00a0<\/i>\u00bb.<\/p>\n<p style=\"text-align: justify;\">La Cour de cassation rappelle dans l\u2019arr\u00eat du 21 janvier 2014 que le juge ne peut \u00e9carter la demande du salari\u00e9 en appliquant les r\u00e8gles du droit du travail fran\u00e7ais\u00a0: \u00ab\u00a0<i>qu\u2019en se d\u00e9terminant ainsi sans rechercher si la condition pos\u00e9e par la convention d\u2019assurance ch\u00f4mage et le r\u00e8glement annex\u00e9 dont elle a fait application,\u00a0 \u00e9tait compatible avec la loi r\u00e9gissant la rupture du contrat de travail, la cour d\u2019appel n\u2019a pas donn\u00e9 de base l\u00e9gale \u00e0 sa d\u00e9cision\u00a0<\/i>\u00bb.<\/p>\n<p style=\"text-align: justify;\">Elle se fonde sur le r\u00e8glement europ\u00e9en n\u00b01408\/71 (**). En effet, le r\u00e8glement CEE n\u00b01408\/71 pr\u00e9voit que les conditions d\u2019attribution des prestations de ch\u00f4mage doivent \u00eatre mises en \u0153uvre en tenant compte des particularit\u00e9s du r\u00e9gime de la rupture du contrat de travail r\u00e9sultant de la loi \u00e9trang\u00e8re applicable au contrat. Autrement dit, il ne peut \u00eatre impos\u00e9 au travailleur de justifier d\u2019une condition incompatible avec la loi \u00e9trang\u00e8re dont rel\u00e8ve le contrat\u00a0: la loi allemande n\u2019exige pas la production d\u2019une ordonnance de r\u00e9f\u00e9r\u00e9.<\/p>\n<p style=\"text-align: justify;\">Cet arr\u00eat invite \u00e0 porter une attention particuli\u00e8re \u00e0 la loi applicable au contrat de travail que se soit au cours de l\u2019ex\u00e9cution du contrat de travail, ou au moment de la rupture. Concr\u00e8tement, les conditions d\u2019attribution de prestations d\u2019assurance ch\u00f4mage\u00a0\u00e0 un salari\u00e9 ne sont pas les m\u00eames selon que se soit la loi fran\u00e7aise ou loi \u00e9trang\u00e8re qui s\u2019applique.<\/p>\n<p style=\"text-align: justify;\">(*) Petit rappel sur les d\u00e9missions consid\u00e9r\u00e9es comme l\u00e9gitimes en droit fran\u00e7ais et qui justifient l\u2019octroi de droits aux allocations ch\u00f4mage\u00a0:<\/p>\n<p style=\"text-align: justify;\"><a href=\"http:\/\/travail-emploi.gouv.fr\/informations-pratiques,89\/fiches-pratiques,91\/demission,120\/le-droit-aux-allocations-chomage,1096.html\">http:\/\/travail-emploi.gouv.fr\/informations-pratiques,89\/fiches-pratiques,91\/demission,120\/le-droit-aux-allocations-chomage,1096.html<\/a><\/p>\n<p style=\"text-align: justify;\">(**) Le r\u00e8glement europ\u00e9en n\u00b01408\/71 organise une coordination des r\u00e9gimes de s\u00e9curit\u00e9 sociale\u00a0: Le travailleur frontalier qui est en ch\u00f4mage complet b\u00e9n\u00e9ficie des prestations selon les dispositions de la l\u00e9gislation de l\u2019Etat membre sur le territoire duquel il r\u00e9side comme si il avait \u00e9t\u00e9 soumis \u00e0 cette l\u00e9gislation au cours de son dernier emploi. De plus, les prestations sont servies par l\u2019institution du lieu de r\u00e9sidence et \u00e0 sa charge.<\/p>\n<a class=\"synved-social-button synved-social-button-share synved-social-size-24
