{"id":2470,"date":"2014-03-20T15:48:59","date_gmt":"2014-03-20T13:48:59","guid":{"rendered":"http:\/\/www.rhexpat.com\/blog\/?p=2470"},"modified":"2015-05-26T11:12:57","modified_gmt":"2015-05-26T09:12:57","slug":"les-conditions-du-retour-en-france-dun-salarie-expatrie","status":"publish","type":"post","link":"https:\/\/www.rhexpat.com\/blog\/les-conditions-du-retour-en-france-dun-salarie-expatrie\/","title":{"rendered":"Les conditions du retour en France d\u2019un salari\u00e9 expatri\u00e9"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Cass. soc., 4 d\u00e9cembre 2013, n\u00b012-23.848 (REJET)<\/strong><\/p>\n<p style=\"text-align: justify;\">Dans un arr\u00eat du 4 d\u00e9cembre 2013, la chambre sociale de la Cour de cassation souligne l\u2019importance de pr\u00e9ciser les conditions de r\u00e9siliation du contrat et de rapatriement du salari\u00e9 avant son d\u00e9part \u00e0 l\u2019\u00e9tranger dans l\u2019avenant d\u2019expatriation.<\/p>\n<p style=\"text-align: justify;\">Un salari\u00e9 est expatri\u00e9 en Chine en qualit\u00e9 d\u2019ing\u00e9nieur technico-commercial. Son contrat de travail limitant son affectation sur le territoire fran\u00e7ais (il envisageait simplement des d\u00e9placements ponctuels \u00e0 l\u2019\u00e9tranger sans aucune clause de mobilit\u00e9 hors de France). Les conditions de son expatriation ont donc \u00e9t\u00e9 pr\u00e9vues dans une \u00ab\u00a0fiche de mission en expatriation\u00a0\u00bb.<\/p>\n<p style=\"text-align: justify;\">L\u2019employeur met fin de fa\u00e7on anticip\u00e9e \u00e0 la mission du salari\u00e9 en raison de \u00ab\u00a0<i>l\u2019absence de perspectives d\u2019affaires \u00e0 terme raisonnable<\/i>\u00a0\u00bb. Elle l\u2019informe qu\u2019il dispose d\u2019un d\u00e9lai de 2 mois pour revenir en France et occuper un nouveau poste. Le salari\u00e9 refuse, il est licenci\u00e9 pour faute grave. \u00a0Il conteste son licenciement.<\/p>\n<p style=\"text-align: justify;\">Les juges du fond font droit \u00e0 la demande du salari\u00e9, ils consid\u00e8rent que le licenciement est sans cause r\u00e9elle et s\u00e9rieuse et condamnent l\u2019employeur \u00e0 payer au salari\u00e9 diverses sommes, et de rembourser \u00e0 P\u00f4le Emploi les indemnit\u00e9s ch\u00f4mages vers\u00e9es au salari\u00e9 dans la limite de six mois. La Cour de cassation confirme la d\u00e9cision des juges du fond.<\/p>\n<p style=\"text-align: justify;\">En effet, selon l\u2019article 1<sup>er<\/sup>, annexe II de la convention collective nationale des ing\u00e9nieurs et cadres de la m\u00e9tallurgie\u00a0 du 13 mars 1972, \u00ab\u00a0<i>Les modalit\u00e9s de l\u2019affectation dans un \u00e9tablissement hors de la m\u00e9tropole doivent \u00eatre pr\u00e9cis\u00e9es par \u00e9crit avant le d\u00e9part de l\u2019ing\u00e9nieur ou cadre, en ce qui concerne les points suivants\u00a0:\u00a0&#8211; la fonction qui sera exerc\u00e9e\u00a0; [&#8230;]. &#8211;\u00a0les conditions de r\u00e9siliation et de rapatriement. Lorsque le contrat de travail d\u2019un ing\u00e9nieur ou cadre ne pr\u00e9voit pas la possibilit\u00e9 de sa mutation dans un \u00e9tablissement permanent situ\u00e9 en dehors du territoire m\u00e9tropolitain, cette affectation est subordonn\u00e9e \u00e0 son accord pr\u00e9alable \u00e9crit sur les points ci-dessus \u00e9num\u00e9r\u00e9s\u00a0<\/i>\u00bb.<\/p>\n<p style=\"text-align: justify;\">Or, la fiche de mission en expatriation ne pr\u00e9voyait pas le d\u00e9lai dans lequel le salari\u00e9 devait \u00eatre inform\u00e9 de son retour en France.<\/p>\n<p style=\"text-align: justify;\">Cet arr\u00eat rappelle, d\u2019une part, qu\u2019il est important de respecter les dispositions pr\u00e9vues par la convention collective, et d\u2019autre part qu\u2019il est opportun de d\u00e9tailler les conditions de r\u00e9siliation et de rapatriement du salari\u00e9.\u00a0 En l\u2019esp\u00e8ce, l\u2019absence de mention du \u00ab\u00a0d\u00e9lai dans lequel le salari\u00e9 devait \u00eatre inform\u00e9 de son retour en France\u00a0\u00bb dans la fiche d\u2019expatriation a permis la condamnation de l\u2019employeur pour non respect de la convention la convention
