{"id":2696,"date":"2015-01-16T15:40:13","date_gmt":"2015-01-16T13:40:13","guid":{"rendered":"http:\/\/www.rhexpat.com\/blog\/?p=2696"},"modified":"2015-05-26T11:09:01","modified_gmt":"2015-05-26T09:09:01","slug":"la-lutte-contre-les-fraudes-au-detachement","status":"publish","type":"post","link":"https:\/\/www.rhexpat.com\/blog\/la-lutte-contre-les-fraudes-au-detachement\/","title":{"rendered":"La lutte contre les fraudes au d\u00e9tachement"},"content":{"rendered":"<p style=\"text-align: justify\">La loi du 10 juillet 2014 sur les travailleurs d\u00e9tach\u00e9s, \u00ab\u00a0visant \u00e0 lutter contre la concurrence sociale d\u00e9loyale\u00a0\u00bb, renforce l\u2019obligation de vigilance des donneurs d\u2019ordre et des maitres d\u2019ouvrage.<\/p>\n<p style=\"text-align: justify\"><span style=\"line-height: 1.5\">Art. L. 1262-2-1. \u2013 <\/span><em style=\"line-height: 1.5\">\u00ab\u00a0I. &#8211; L&#8217;employeur qui d\u00e9tache un ou plusieurs salari\u00e9s, dans les conditions pr\u00e9vues aux articles L. 1262-1 et L. 1262-2, adresse une d\u00e9claration, pr\u00e9alablement au d\u00e9tachement, \u00e0 l&#8217;inspection du travail du lieu o\u00f9 d\u00e9bute la prestation.\u00a0\u00bb\u00a0;<\/em><\/p>\n<p style=\"text-align: justify\"><em style=\"line-height: 1.5\">\u00ab II. &#8211; L&#8217;employeur mentionn\u00e9 au I du pr\u00e9sent article d\u00e9signe un repr\u00e9sentant de l&#8217;entreprise sur le territoire national, charg\u00e9 d&#8217;assurer la liaison avec les agents mentionn\u00e9s \u00e0 l&#8217;article L. 8271-1-2 pendant la dur\u00e9e de la prestation. \u00bb ;<\/em><\/p>\n<p style=\"text-align: justify\"><span style=\"line-height: 1.5\">Art. L. 1262-4-1.<\/span><em style=\"line-height: 1.5\"> \u2013 \u00ab\u00a0Le donneur d&#8217;ordre ou le ma\u00eetre d&#8217;ouvrage qui contracte avec un prestataire de services qui d\u00e9tache des salari\u00e9s, dans les conditions mentionn\u00e9es aux articles L. 1262-1 et L. 1262-2, v\u00e9rifie aupr\u00e8s de ce dernier, avant le d\u00e9but du d\u00e9tachement, qu&#8217;il s&#8217;est acquitt\u00e9 des obligations mentionn\u00e9es aux I et II de l&#8217;article L. 1262-2-1.\u00a0\u00bb.<\/em><\/p>\n<p style=\"text-align: justify\"><span style=\"line-height: 1.5\">Le projet de loi pr\u00e9voit plusieurs mesures pour renforcer la lutte contre les fraudes au d\u00e9tachement transnational de travailleurs.<\/span><\/p>\n<p style=\"text-align: justify\"><strong style=\"line-height: 1.5\"><em><span style=\"text-decoration: underline\">RAPPEL des formalit\u00e9s li\u00e9es au d\u00e9tachement<\/span><\/em><\/strong><\/p>\n<p style=\"text-align: justify\"><span style=\"line-height: 1.5\">Selon l\u2019article L. 1262-2-1 du Code du Travail, l\u00a0\u2018employeur \u00e9tablit hors de France qui d\u00e9tache des salari\u00e9s sur le territoire national pour y r\u00e9aliser une prestation doit adresser, pr\u00e9alablement au d\u00e9tachement, une d\u00e9claration de<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"line-height: 1.5\">D\u00e9tachement aupr\u00e8s de l\u2019inspection du travail du lieu o\u00f9 d\u00e9bute la prestation. Il doit, en outre, d\u00e9signer un repr\u00e9sentant de l\u2019entreprise sur le territoire national, lequel sera charg\u00e9 d\u2019assurer la liaison avec l\u2019inspection du travail, notamment pendant la dur\u00e9e de la prestation.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"line-height: 1.5\">Quant au maitre d\u2019ouvrage ou au donneur d\u2019ordre qui a recours \u00e0 un prestataire de services \u00e9tabli \u00e0 l\u2019\u00e9tranger d\u00e9tachant des salari\u00e9s en France, il doit v\u00e9rifier aupr\u00e8s de ce dernier, avant le d\u00e9but du d\u00e9tachement, qu\u2019il s\u2019est bien acquitt\u00e9 de ses obligations de d\u00e9claration et de d\u00e9signation <\/span><em style=\"line-height: 1.5\">(C. trav., art. L. 1262-4-1)<\/em><span style=\"line-height: 1.5\">.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"line-height: 1.5\">Les moyens de lutte contre les fraudes au d\u00e9tachement ont \u00e9t\u00e9 renforc\u00e9s. En cas de non respect de ces formalit\u00e9s li\u00e9es au d\u00e9tachement, certaines dispositions ont \u00e9t\u00e9 mises en place\u00a0:<\/span><\/p>\n<p style=\"text-align: justify\"><strong>Augmentation de l\u2019amende pour manquement aux formalit\u00e9s li\u00e9es au d\u00e9tachement<\/strong><\/p>\n<p style=\"text-align: justify\">Le projet de loi aggrave la sanction financi\u00e8re administrative, institu\u00e9e par la loi n\u00b02014-790 du 10 juillet 2014, encourue par l\u2019employeur \u00e9tabli \u00e0 l\u2019\u00e9tranger et par le donneur d\u2019ordre ou le maitre d\u2019ouvrage en cas de non respect des formalit\u00e9s li\u00e9es au d\u00e9tachement.<\/p>\n<p style=\"text-align: justify\">Tout manquement de l\u2019employeur qui d\u00e9tache des salari\u00e9s en France \u00e0 l\u2019une de ses obligations (d\u00e9claration ou d\u00e9signation) et tout manquement du donneur d\u2019ordre ou du maitre d\u2019ouvrage \u00e0 son obligation de v\u00e9rification (seulement si l\u2019employeur qui d\u00e9tache les salari\u00e9s est lui- m\u00eame d\u00e9faillant) est passible d\u2019une amende administrative (<em>C. trav., art. L. 1264-1 et L. 1264-2).<\/em><\/p>\n<p style=\"text-align: justify\">Le montant de cette amende est actuellement fix\u00e9 \u00e0 2000 \u20ac maximum par salari\u00e9 d\u00e9tach\u00e9 (4000 \u20ac en cas de r\u00e9cidive). Son montant total est pass\u00e9 de 10 000 \u20ac \u00e0 150 000 \u20ac <em>(C. trav., art. L. 1264- 3).<\/em><\/p>\n<p style=\"text-align: justify\"><strong>Suspension d\u2019activit\u00e9 en cas de violation des droits fondamentaux des salari\u00e9s d\u00e9tach\u00e9s<\/strong><\/p>\n<p style=\"text-align: justify\">Le projet de loi autorise l\u2019administration \u00e0 ordonner la suspension de la prestation, \u00e0 titre provisoire, pour une dur\u00e9e de <strong>un mois<\/strong>, en cas de manquement grave de l\u2019employeur aux dispositions l\u00e9gales relatives au paiement du <strong>salaire minimum<\/strong> l\u00e9gal (<em>C. trav., art. L. 3231- 2)<\/em>, aux <strong>dur\u00e9es <\/strong>quotidienne ou hebdomadaire maximales de <strong>travail<\/strong> <em>(C. trav., art. L. 3121-34 et L. 3121-35) <\/em>ou de <strong>conditions de travail <\/strong>ou d\u2019h\u00e9bergement incompatibles avec la dignit\u00e9 humaine <em>(C. p\u00e9n., art. 225- 14).<\/em> La d\u00e9cision de suspension d\u2019activit\u00e9 n\u2019entrainerait ni rupture, nu suspension du contrat de travail, ni <strong>aucun pr\u00e9judice p\u00e9cuniaire<\/strong> \u00e0 l\u2019encontre des <strong>salari\u00e9s<\/strong>.<\/p>\n<p style=\"text-align: justify\">Lorsque l\u2019inspection du travail constate un manquement grave de l\u2019employeur, tel que pr\u00e9cit\u00e9, elle devrait enjoindre par \u00e9crit \u00e0 ce dernier de faire cesser la situation, dans un d\u00e9lai devant \u00eatre fix\u00e9 par d\u00e9cret en Conseil d\u2019Etat. L\u2019inspection du travail en informerait dans le m\u00eame temps le maitre d\u2019ouvrage ou le donneur d\u2019ordre.<\/p>\n<p style=\"text-align: justify\"><strong>En cas de non respect de la suspension,<\/strong> l\u2019employeur est passible d\u2019une amende administrative, \u00e9gale, au plus, \u00e0 10 000 \u20ac par salari\u00e9 concern\u00e9 par le manquement (montant qui d\u00e9pend de la gravit\u00e9 du manquement, du comportement de l\u2019employeur, de ses ressources, et ses charges\u2026).<\/p>\n<p style=\"text-align:
