Quatre ans plus tard il est notifi\u00e9 au salari\u00e9 la fin du d\u00e9tachement et son rappel en m\u00e9tropole \u00e0 son lieu\u00a0 d&#8217;affectation \u00a0contractuelle, ce qu\u2019il refuse. Il est alors licenci\u00e9 pour faute grave.<\/p>\n<p style=\"text-align: justify;\">Le licenciement est sans cause r\u00e9elle et s\u00e9rieuse selon le salari\u00e9 d\u00e8s lors que l&#8217;employeur ne peut imposer au salari\u00e9 une modification de son contrat de travail et que constitue une modification du contrat de travail la mutation du salari\u00e9 hors de son secteur g\u00e9ographique d&#8217;activit\u00e9.<\/p>\n<p style=\"text-align: justify;\">Mais la Cour de cassation ne suit pas cette argumentation et rappelle que la r\u00e9int\u00e9gration du salari\u00e9 dans un emploi en r\u00e9gion parisienne ne r\u00e9sultait pas de la mise en \u0153uvre d&#8217;une clause de mobilit\u00e9 g\u00e9ographique mais du terme du d\u00e9tachement. D\u00e8s lors, elle ne constituait pas une modification du contrat de travail n\u00e9cessitant l\u2019accord du salari\u00e9, et son refus constituait bien une faute grave rendant impossible son
