{"id":8974,"date":"2018-04-18T16:20:37","date_gmt":"2018-04-18T14:20:37","guid":{"rendered":"http:\/\/www.rhexpat.com\/blog\/?p=8974"},"modified":"2020-07-28T11:10:59","modified_gmt":"2020-07-28T09:10:59","slug":"licenciement-dun-salarie-pour-refus-de-reintegration-au-sein-de-la-societe-dorigine","status":"publish","type":"post","link":"https:\/\/www.rhexpat.com\/blog\/licenciement-dun-salarie-pour-refus-de-reintegration-au-sein-de-la-societe-dorigine\/","title":{"rendered":"Licenciement d&#8217;un salari\u00e9 pour refus de r\u00e9int\u00e9gration au sein de la soci\u00e9t\u00e9 d&#8217;origine"},"content":{"rendered":"<p style=\"text-align: justify;\">La Chambre sociale de la Cour de Cassation a rendu sa d\u00e9cision, dans son arr\u00eat n\u00b016-18.946 du 7 f\u00e9vrier 2018, quant au licenciement d\u2019un salari\u00e9 suite \u00e0 son refus de r\u00e9int\u00e9grer la soci\u00e9t\u00e9 d\u2019origine apr\u00e8s la fin de son d\u00e9tachement \u00e0 l\u2019\u00e9tranger.<\/p>\n<p style=\"text-align: justify;\">En cas de d\u00e9tachement au sens du droit du travail, c\u2019est-\u00e0-dire lorsque le contrat de travail avec la soci\u00e9t\u00e9 d\u2019origine est maintenu, il est impos\u00e9 \u00e0 l\u2019employeur de r\u00e9int\u00e9grer le salari\u00e9 au sein de la soci\u00e9t\u00e9 d\u2019origine \u00e0 l\u2019issue de sa mission \u00e0 l\u2019\u00e9tranger.<\/p>\n<p style=\"text-align: justify;\">En l\u2019esp\u00e8ce, le salari\u00e9 a refus\u00e9 de r\u00e9int\u00e9grer le poste propos\u00e9 par son employeur du fait du caract\u00e8re tardif de la proposition de reclassement, faite quelques jours avant la fin de sa mission \u00e0 l\u2019\u00e9tranger, suite \u00e0 quoi l\u2019employeur a d\u00e9cid\u00e9 de le licencier.<\/p>\n<p style=\"text-align: justify;\">La Cour de Cassation a retenu que <strong>l\u2019employeur a respect\u00e9 ses obligations pr\u00e9vues dans le contrat de travail<\/strong> et qui \u00e9taient&nbsp;de reclasser le salari\u00e9 \u00ab&nbsp;\u00e0 son poste ou [\u2026] \u00e0 un poste \u00e9quivalent, soit en France, soit \u00e0 l\u2019\u00e9tranger&nbsp;\u00bb, de lui faire \u00ab&nbsp;au moins une proposition de reclassement&nbsp;\u00bb et ce \u00ab&nbsp;au plus tard \u00e0 la date connue du retour pr\u00e9vu en France&nbsp;\u00bb.<\/p>\n<p style=\"text-align: justify;\">De plus, en diff\u00e9rant sa date de prise de poste en France et en acceptant de prendre en charge les frais de scolarit\u00e9 des enfants pour un temps suppl\u00e9mentaire, <strong>l\u2019employeur a laiss\u00e9 le temps et a propos\u00e9 des mesures pour que le salari\u00e9 puisse organiser son retour en France. <\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>&nbsp;<\/strong>La Haute Juridiction pr\u00e9cise que le salari\u00e9 ne peut refuser son reclassement (un tel acte peut d\u2019ailleurs constituer une faute grave<sup>1<\/sup>) et rel\u00e8ve que l\u2019employeur a tenu compte de la situation personnelle du salari\u00e9 lors de la mise en \u0153uvre de sa r\u00e9int\u00e9gration, qui constitue un changement des conditions de travail et non pas une modification du contrat de travail. <strong>Son licenciement repose ainsi sur une cause r\u00e9elle et s\u00e9rieuse.<\/strong><\/p>\n<p style=\"text-align: justify;\">Toutefois, il est \u00e0 pr\u00e9ciser que dans d\u2019autres circonstances, par exemple dans le cas o\u00f9 la proposition de r\u00e9int\u00e9gration ne serait pas conforme \u00e0 ce qui \u00e9tait pr\u00e9vu par les deux parties ou dans le cas o\u00f9 l\u2019employeur ne tiendrait pas compte de la situation personnelle du salari\u00e9 au moment de la mise en \u0153uvre de sa r\u00e9int\u00e9gration, il n\u2019est pas exclu qu\u2019il y ait faute de la part de l\u2019employeur.<\/p>\n<p style=\"text-align: justify;\">Dans les avenants au contrat de travail, la r\u00e9daction des clauses de r\u00e9int\u00e9gration au sein de la soci\u00e9t\u00e9 d\u2019origine \u00e0 l\u2019issue d\u2019une mission \u00e0 l\u2019\u00e9tranger doit particuli\u00e8rement \u00eatre soign\u00e9e. Il est aussi essentiel de tenir compte de la convention collective de travail s\u2019appliquant \u00e0 l\u2019entreprise. En effet, dans certains cas, cette derni\u00e8re peut m\u00eame imposer le reclassement du salari\u00e9 sur un type de poste bien pr\u00e9cis et c\u2019est notamment le cas de la convention collective des ing\u00e9nieurs et cadres de la m\u00e9tallurgie, qui impose aux employeurs \u00ab&nbsp;d\u2019affecter [les salari\u00e9s] d\u00e8s leur retour \u00e0 des emplois aussi compatibles que possible avec l&#8217;importance de leurs fonctions ant\u00e9rieures \u00e0 leur rapatriement&nbsp;\u00bb, autrement dit aux fonctions occup\u00e9es durant la mission \u00e0 l\u2019\u00e9tranger.<\/p>\n<p style=\"text-align: justify;\">Pour consulter l\u2019arr\u00eat Cass.
